    Rent agreement is a key document meant to establish a transparent transaction between landlord and tenant. The Model Tenancy Act 2019, aims to make renting more lucrative for both, landlords and tenants, to bridge gaps that prevail in the existing policies.

    • According to this act, a landlord needs to give a written notice three month prior to the revision of the rent.

    • Tenant will have to pay security deposit in advance for a maximum of sum of two months rent.

    • Landlords and tenants both require to submit a copy of the rent agreement to the district rent authority.

    • In case, a landlord declines to pay for the required repair, the tenant can get the work done and deduct the amount from monthly rent.

    • A landlord needs to provide a 24-hour notice before entering the rented premises for repairment or renovation process.

    • If tenants extending their stay beyond the stated term in the rental agreement would be liable to pay double the rent for the first two months and four times the rent thereafter.

    • If a dispute arises with the tenant, the landlord is not permitted to cut the power & water supply.

    Benefits of landlord:

    • The policy states that tenants would be liable to pay the landlords double the rent for two months and four times the rent in the consequent months, in case they stay after expiry of the rental agreement.

    • Under the model policy, landlords could approach the rent court asking for eviction, if the tenants fail to pay the rent for two months in a row.

    • The Tenants are restricted from subletting whole or a portion of the rented property.

    Benefits of Tenant:

    • During the entire rent agreement period, landlords cannot hike the rent.

    • The landlord will have to give three months’ notice to the tenant, before increasing the rent.

    • Only landlords are accountable for the structural maintenance of the rental property.

    How to register a rent agreement?

    • Visit the nearest sub-registrar’s office for registration.

    • You have to buy the stamps of the requisite value. You can purchase e-stamped paper of any value from designated vendors.

    • If one decides to go for a tenancy period of less than 11 months, then a stamp paper of Rs 20-100 can be used for the purpose.

    • Both tenants and landlords along with the two witnesses need to carry their passport size photographs and ID Proofs like Aadhar card, driving license, voter ID card, passport, PAN card for validation.

    • If both the parties are not present at the same time, he/she must sign the Power of Attorney, granting attorney the rights of agreement closure.

    How to Register Tenancy Agreement in online mode?

    The Tamil Nadu Government has also launched an exclusive portal www.tenancy.tn.gov.in to create the registration of rent/lease agreements.

    Step-1: Visit www.tenancy.tn.gov.in – Tamil nadu Housing and Urban Development department Portal

    Step-2: Click Register option on the right side corner of the webpage

    Step-3:

    Under Registration form enter the basic details

    • Enter Your Full Name

    • Select your District

    • Select your Taluk

    • Enter your Mobile Number

    • Enter your E-mail ID

    • Enter your Aadhar Number

    • Enter your Desired Login ID

    • Enter your secret Password and Please enter confirm Password

    • Enter captcha Code and click Sign Up Button

    Step-4: After Successful Sign Up OTP has been sent to the registered email id and mobile No.

    • Enter OTP and Click Verify OTP button

    Your user Registration Successfully Completed use log in option to create Online Rent Agreement e-Registration

    Step-5: After Login Click Housing and Urban Development Department -----Application for Registration of Tenancy Agreement

    Based on the input form supporting documents will be listed Similarly add the mandatory documents listed

    • After adding all documents click on “Make Payment” submit button

    • Once payment got successful you will get “Receipt”

    • Applicant shall track their Tenancy Registration Certificate status under “Check Status” option

    • Once applicant is digitally signed Tenancy Registration Certificate PDF file download option will be enable on check status

    An amount Rs. 50 is needed to be paid for registration of rental Agreement in E-Service.

    Rental agreement will be created on a stamp paper between the owner and the tenant with Nimmadhi as the guardian to the owner’s property. Nimmadhi will be responsible in executing the terms in the agreement. Rental agreement will be signed by the tenant and Nimmadhi.
